By using our website or engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms and Conditions in full. If you are acting on behalf of another person, you confirm that you are authorised to do so.

Mesra Guaman provides family legal services to clients in Malaysia, principally those whose matters fall under civil family law. Our services are available to individuals ordinarily resident in Malaysia or whose legal matter is subject to Malaysian jurisdiction. We do not provide financial advice, psychological counselling, or services outside the scope of legal practice.

4. Engagement and Client Instructions

An engagement commences when both parties have signed a written fee agreement and the agreed initial payment has been received. Until that point, no formal solicitor-client relationship exists, and any preliminary advice is provided on a general information basis only. You are responsible for providing accurate and complete information to allow us to advise and act effectively on your behalf.

5. Fees and Payment

Our fees are set out in the engagement letter provided before work commences. Standard service fees are as follows:

Where a matter is more complex than standard, additional fees will be discussed and agreed with you before any further work is undertaken. Payment is accepted by bank transfer or such methods as confirmed in your engagement letter. Fees are payable in Malaysian Ringgit (RM). The consultation fee is credited toward further service fees if you proceed to engage Mesra Guaman for that matter.

6. Confidentiality

All information shared with Mesra Guaman in the course of an engagement is subject to legal professional privilege and our confidentiality obligations under the Legal Profession Act 1976 (Malaysia) and the Personal Data Protection Act 2010. We will not disclose client information to third parties except as required by law, court order, or with your explicit written consent.

7. Intellectual Property

All content on our website — including text, design elements, and structure — is the property of Mesra Guaman and is protected by Malaysian copyright law. You may not reproduce, distribute, or use any content from our website for commercial purposes without our prior written consent. Legal documents prepared for you as part of your engagement remain confidential to your matter.

8. Scope of Legal Advice

Legal advice provided by Mesra Guaman is specific to your matter and the facts you have provided. It does not constitute general legal guidance applicable to any other person or situation. We do not make promises as to the outcome of any legal matter. The law changes, and our advice reflects the position at the time it is given. You should seek updated advice if significant time passes before acting.

9. Limitation of Liability

To the extent permitted by law, Mesra Guaman's liability to you for any claim arising from our services is limited to the fees paid by you in respect of the specific matter from which the claim arises. We are not liable for indirect, consequential, or special losses. Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

10. Termination

Either party may terminate the engagement by providing written notice. If you terminate, you remain liable for fees incurred up to the date of termination. We may cease to act if you fail to provide instructions, fail to make agreed payments, or if a conflict of interest arises that cannot be managed. Upon termination, we will return your original documents promptly.

If you are dissatisfied with any aspect of our service, please contact us in writing at [email protected]. We will acknowledge your complaint within five working days and aim to respond fully within 21 working days. If you remain dissatisfied, you may contact the Malaysian Bar's Complaints Committee.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage informal resolution in the first instance. If that is not possible, disputes will be subject to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed venue.

The content on our website is provided for general information only and does not constitute legal advice. While we take care to keep information accurate, we make no representations as to its completeness or currency. Use of this website is at your own risk.
